1. Agreement to Terms

By accessing or using the Katzilla platform ("Service"), API, SDK, website at katzilla.dev, or any related services operated by Katzilla ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, developers, and others who access the Service. By creating an account, you represent that you are at least 18 years old and have the legal authority to enter into these Terms.

2. Description of Service

Katzilla is a data API platform that provides unified access to public data sources including government databases, international organizations, and open data providers (USGS, NOAA, FRED, NASA, WHO, World Bank, and others). We aggregate, normalize, and serve read-only data through a REST API and SDKs.

The Service includes: the REST API at api.katzilla.dev, the @katzilla/sdk npm package, Katzilla Scrape, the web dashboard at katzilla.dev, documentation, MCP server, and all related tools.

3. Accounts & API Keys

  • You are responsible for maintaining the security of your account credentials and API keys.
  • You must not share API keys publicly (e.g., in client-side code, public repositories, or logs).
  • You are responsible for all activity that occurs under your account, whether or not authorized by you.
  • Notify us immediately at security@katzilla.dev if you believe your credentials have been compromised.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Data Sources & Accuracy

Katzilla aggregates data from third-party public sources. While we strive to serve accurate and up-to-date information, we do not guarantee the accuracy, completeness, or timeliness of any data.

  • Data is provided "as is" from upstream sources (USGS, NOAA, FRED, NASA, etc.).
  • We are not responsible for errors, omissions, or delays in upstream data.
  • You should not rely on Katzilla data for safety-critical decisions (e.g., emergency evacuation) without verifying against official sources.
  • Data availability depends on upstream API availability. We do not guarantee 100% uptime for any data source.
  • We may add, modify, or remove data sources at any time.

5. Pricing & Usage Limits

  • The Free plan includes 1,000 requests per month at no cost, with no credit card required.
  • Paid plans (Pro, Business, Enterprise) provide higher request limits. See Pricing for current rates.
  • All plans include access to every data source and category.
  • Exceeding your plan's monthly quota will result in HTTP 429 responses or overage billing, depending on your tier.
  • Paid subscriptions are billed monthly or annually via Stripe. You may cancel at any time; service continues until the end of the billing period.
  • Refunds are available within 14 days of initial purchase. No refunds for partial months after the 14-day window.
  • We reserve the right to adjust pricing with 30 days' notice to existing subscribers.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Circumvent rate limits, authentication, or other security measures.
  • Attempt to gain unauthorized access to the Service, other accounts, or underlying data systems.
  • Resell, redistribute, or re-serve Katzilla API responses as your own data service without adding meaningful value.
  • Use automated systems to scrape or bulk-download data in a way that degrades the Service for other users.
  • Use the Service to compete directly with Katzilla or build a substantially similar product.
  • Misrepresent data sourced from Katzilla as originating from another provider or as your own primary research.

7. Third-Party Data Providers

Katzilla serves data from public APIs operated by government agencies and international organizations. Your use of this data may also be subject to the terms and policies of the original providers.

We do not claim ownership of third-party data. Attribution requirements from upstream sources are passed through in API responses where applicable. You are responsible for complying with any licensing or attribution requirements of the original sources.

8. Rate Limits

The Service enforces rate limits based on your plan tier. All plans are subject to per-minute rate limits to ensure fair usage. Authentication endpoints are limited to 5 requests per minute per IP. Exceeding limits results in HTTP 429 responses. Enterprise plans with custom limits are available upon request.

9. Intellectual Property

The Service, including its code, design, documentation, SDK, and branding, is owned by Katzilla and protected by copyright and other intellectual property laws. The data served through the API originates from public sources and is subject to their respective licenses.

The @katzilla/sdk is provided under the MIT license. The Katzilla name, logo, and brand marks may not be used without written permission.

10. Disclaimer of Warranties

The Service and all data are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will be accurate, complete, or current. We disclaim all warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Katzilla shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service or reliance on data obtained through the Service.

Our total liability for all claims related to the Service shall not exceed the amount you paid to Katzilla in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Katzilla, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

You may close your account at any time by contacting support@katzilla.dev. We may suspend or terminate your access at our discretion, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Paid subscriptions are not refunded for the remaining billing period upon voluntary account closure (except within the 14-day refund window).

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the website at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
